In seeking to deliver the best student experience, an institution will sometimes require its employees to ‘go the extra mile’, for example by working additional hours or taking on extra duties. In doing so, the institution must balance its operational needs against its duty to ensure the health and wellbeing of its staff.
Looking more broadly, there are significant commercial and operational benefits for institutions to promote staff wellbeing beyond basic legal requirements.
In this session, employment law specialists from Eversheds Sutherland will consider the nature and scope of this duty and the legal framework on which it is based, including health and safety legislation, contractual and statutory duties, the Equality Act 2010 and statutory employment protections. The session will explore some examples of where these duties may be engaged – including, for example, in the context of managing ill-health, absences and flexible working arrangements - and look at the practical steps that institutions can take to ensure compliance.
