An event organised with our partner, Intersol Global, who are helping our members to prepare for possible outcomes from the OfS consultation on the new approach to regulating harassment and sexual misconduct.
The session will be over two areas:
Part 1:
Part 1 of our session aims to help address Proposal B, part G of the minimum content requirements:
- How the provider ensures that investigations undertaken and decisions made in respect of incidents of harassment and/or sexual misconduct are credible, fair and otherwise reflect established principles of natural justice
The trainers will cover the following key points:
- Investigations into harassment and sexual misconduct involve complex issues and a providers arrangements to investigate such reports should include investigators with relevant training and skills to carry out the role
- The investigator’s role is to gather information and evidence on which the decision maker can make credible and fair decisions
- Understanding the impact trauma can have on individuals memory, treating all parties equally and avoiding bias is key to fair outcomes
Part 2:
Part 2 of our session aims to help address Proposal B, part F of the minimum content requirements:
- How the provider ensures that staff and other persons responsible for receiving information about, investigating, or taking decisions on, matters relating to incidents of harassment and/or sexual misconduct are appropriately trained
The trainers will cover the following key points:
- Training should be meaningful and of a duration that staff are given time to learn and understand the issues relating to investigating harassment and/or sexual misconduct
- Training should be certified – giving staff successfully completing the training recognised qualifications
- Decision makers should receive meaningful training in making evidential based decisions on the balance of probabilities
